Privacy Policy and Waiver of Liability

READ CAREFULLY – THIS AFFECTS YOUR LEGAL RIGHTS

In exchange for participating in the fashion walking tours offered by MEXICO FASHION TOURS, and/or using the property, facilities, and services of MEXICO FASHION TOURS, I agree for myself and, if applicable, for the members of my family, to the following release of liability (WAIVER).

By participating in any activity, the participant agrees to each of the following provisions of this waiver, release of liability, indemnification, consent to medical attention, and grant of rights:

1. AGREEMENT TO FOLLOW DIRECTIONS
I agree to observe and obey all posted rules and warnings and further agree to follow any oral instructions or directions given by MEXICO FASHION TOURS, or the employees, representatives, or agents of MEXICO FASHION TOURS.

2. ASSUMPTION OF RISKS AND RELEASE
I recognize that there are inherent risks associated with the fashion walking tour activities and I assume full responsibility for personal injury to myself and, if applicable, my family members. I further release and dischargeMEXICO FASHION TOURS for any injury, loss, or damage arising out of my or my family’s use of or presence upon the facilities of MEXICO FASHION TOURS], whether caused by my fault, my family’s fault, MEXICO FASHION TOURS fault, or that of other third parties. By participating in the activities offered by MEXICO FASHION TOURS, both parties agree that: a. I accept all risks and responsibilities associated with the tour activities. b. I am in good health and if I have any limitations (physical, mental, psychological), I am responsible for communicating them and accept all risk and responsibility for any consequences arising from participation (e.g., allergic reactions, falls, sickness, psychological episodes). c. My participation is at my own risk and I am responsible for my own insurance.

3. RELEASE OF LIABILITY AND DAMAGES
By participating in any activity offered directly by MEXICO FASHION TOURS, I release MEXICO FASHION TOURS from any liability for damages. This release includes its affiliated entities, trademarks, subsidiaries, present and former employees, owners, officers, members, managers, partners, and collaborators (collectively "Released Entities"). This release covers any and all claims, actions, damages, liabilities, losses, costs, and expenses related to my participation in MEXICO FASHION TOURS activities. [Your Company Name] is not liable for any damages resulting from negligence or misconduct on the participant's part.

4. INDEMNIFICATION
I agree to indemnify and defend MEXICO FASHION TOURS against all claims, causes of action, damages, judgments, costs, or expenses, including attorney fees and other litigation costs, which may arise from my or my family’s use of or presence on the facilities of MEXICO FASHION TOURS.

5. FEES
I agree to pay for any damages to MEXICO FASHION TOURS facilities caused by negligent, reckless, or willful actions by me or my family.

6. APPLICABLE LAW
Any legal or equitable claim arising from participation in the activities shall be resolved under Mexican law.

7. NO DURESS
I agree and acknowledge that I am under no pressure or duress to adhere to this Agreement and that I have been given a reasonable opportunity to review it before participating in any activity. I further acknowledge that I am free to have my own legal counsel review this Agreement if I so desire.

8. ARM'S LENGTH AGREEMENT
This Agreement and its terms are the product of an arm's length negotiation between the parties. In the event any ambiguity is found in the interpretation of this Agreement, or any of its provisions, the parties explicitly reject the application of any legal or equitable rule of interpretation that would lead to a construction for or against a particular party based on their status as the drafter of a specific term, language, or provision.

9. ENFORCEABILITY
The invalidity or unenforceability of any provision of this Agreement, whether standing alone or applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or other applications of such provision, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.
